Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of the Kard platform, including the website at kard.gg, the venue dashboard, and any loyalty passes issued through the service (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you are signing up on behalf of a business, you confirm that you have authority to bind that business. "You" refers to the venue operator or person accessing the Service.

2. About the Service

Kard enables venue operators — cafés, restaurants, kiosks, and similar businesses — to create digital loyalty stamp cards. Venues generate a QR code that customers scan to add the loyalty card to Apple Wallet or Google Wallet on their mobile devices. The Service includes a dashboard for managing loyalty card settings and viewing stamp activity.

Kard is not affiliated with, endorsed by, or a partner of Apple Inc. or Google LLC. "Apple Wallet" is a trademark of Apple Inc. "Google Wallet" is a trademark of Google LLC. Pass delivery relies on infrastructure provided by Apple and Google; Kard does not guarantee availability of those platforms.

3. Eligibility

To use the Service you must:

  • Be at least 18 years old.
  • Operate a legitimate business and use the Service only for that business's loyalty programme.
  • Provide accurate, truthful registration information and keep it up to date.
  • Not be prohibited from using the Service under applicable law.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at ged.miseikis@gmail.com if you suspect unauthorised access.

You may not share your account with others or create accounts for third parties without their knowledge.

5. Acceptable use

You agree not to use the Service to:

  • Create loyalty programmes that are misleading, fraudulent, or deceptive.
  • Collect, use, or disclose end-customer data in a way that violates applicable data protection law, including the GDPR.
  • Distribute malware or attempt to gain unauthorised access to Kard's systems.
  • Resell or sublicense access to the Service without our written permission.
  • Violate any applicable law, regulation, or third-party rights.

We reserve the right to suspend or terminate accounts that we determine, in our reasonable judgement, are being used in violation of these Terms.

6. Loyalty passes and pass delivery

When you issue a loyalty pass through Kard, pass data (venue name, stamp count, reward description) is transmitted to Apple and Google to enable the pass to appear on your customers' devices. You are responsible for ensuring that the content of your loyalty cards is accurate and not misleading.

Pass delivery depends on Apple Wallet and Google Wallet infrastructure, which Kard does not control. We do not guarantee that every customer will be able to add a pass to their device, and we are not liable for failures caused by third-party platforms.

7. Your obligations as a venue operator

  • You are responsible for informing your customers that their stamp activity is tracked through the Kard service and for providing them with any privacy notice required by law.
  • You must honour the rewards advertised on your loyalty card. Kard is not responsible for disputes between you and your customers.
  • You must comply with all applicable laws governing consumer loyalty programmes in your jurisdiction.

8. Pricing and payment

The Service is available on a free tier and paid subscription plans. Current pricing is listed at kard.gg/#pricing. Prices are shown in Euros and exclude VAT where applicable.

Paid subscriptions are billed monthly in advance. You authorise us to charge the payment method on file on each billing date. If payment fails, we may suspend your account until payment is resolved.

We reserve the right to change pricing with at least 30 days' notice. If you do not accept a price change, you may cancel your subscription before the change takes effect.

9. Cancellation and refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months except where required by applicable law.

If you are a consumer based in the European Union, you have the right to withdraw from a subscription contract within 14 days of purchase without giving a reason, unless the service has already been fully performed with your explicit consent.

10. Intellectual property

Kard retains all rights to the platform, software, and any materials we create. By uploading branding assets (logos, images) to the Service, you grant us a limited licence to use them solely for generating and displaying your loyalty passes.

You retain ownership of your venue data and branding assets. On account closure, we will provide a copy of your data on request within 30 days.

11. Availability and modifications

We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may carry out maintenance, updates, or changes to the Service at any time, with or without notice.

We may modify or discontinue features of the Service. If we discontinue the Service entirely, we will give at least 60 days' notice to active subscribers.

12. Limitation of liability

To the maximum extent permitted by law, Kard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from the Service shall not exceed the amount you paid to Kard in the 12 months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold harmless Kard and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Ireland, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, unless mandatory consumer protection laws in your country of residence provide otherwise.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may close your account before they take effect.
